Terms & Conditions

Effective date: September 3, 2026

These Terms & Conditions (“Terms”) govern your access to and use of the secure transportation services and related websites (collectively, the “Services”) offered by or on behalf of TrueCare 5280 (“Operator,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

1. The Services

TrueCare 5280 provides secure transportation that we operate ourselves. We do not broker trips to other transportation companies. A ride request is a request for service—not a confirmed reservation—until we accept and confirm it. We may decline, reschedule, or cancel a trip when we cannot safely or lawfully complete it.

2. Eligibility and requests

You must provide accurate request information and keep contact details current. You are responsible for information submitted on your behalf. Notify us promptly at admin@truecare5280.com if a ride needs to change or if you suspect unauthorized use of your contact details.

3. Text messaging (SMS) terms

By providing your mobile number and opting in where consent is required, you consent to receive text messages from us relating to the Services as described at the point of collection (for example, ride updates or operational notices).

  • Frequency: Message frequency varies based on your rides and service settings.
  • Cost: Message and data rates may apply; contact your carrier with questions about your plan.
  • Opt-out: You may opt out of promotional texts as instructed in those messages (e.g., STOP). Operational messages may continue where permitted.
  • Support: Reply HELP or email admin@truecare5280.com.
  • Carriers: Participating carriers may change; we are not responsible for delays or failures by carriers or networks.

Our collection and use of phone numbers and related data is described in our Privacy Policy.

4. Acceptable use

You agree not to:

  • Violate law or third-party rights;
  • Provide false pickup, drop-off, or passenger information;
  • Interfere with or disrupt the Services or our operations;
  • Use the Services to send spam, unlawful, or misleading communications;
  • Use the Services in any way that could harm passengers, drivers, the public, or transportation safety.

5. Content and data

You retain your rights in content you submit. You grant us a license to use, store, and process such content as needed to provide and improve the Services and comply with law. You represent that you have the rights necessary to grant this license, including authority to share passenger information when you request a ride for someone else.

6. Third-party services

The Services may use or link to third-party services (maps, messaging providers, payment processors, etc.). Those services are governed by their own terms and privacy policies; we are not responsible for third-party services.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE THAT EVERY REQUESTED RIDE CAN BE COMPLETED AT THE REQUESTED TIME. THESE TERMS DO NOT REPLACE COMPLIANCE WITH APPLICABLE TRANSPORTATION, SAFETY, OR INSURANCE REQUIREMENTS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF NO FEES WERE PAID. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Indemnity

You will defend, indemnify, and hold harmless the Operator and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

10. Termination

We may suspend or decline service for violation of these Terms or for operational or legal reasons. You may stop using the Services at any time. Provisions that by their nature should survive (including disclaimers, limitations, indemnity, and governing law) will survive termination.

11. Governing law and disputes

These Terms are governed by the laws of the State of Colorado and the United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your jurisdiction apply. Courts in Colorado (or federal courts located there, if applicable) will have exclusive jurisdiction for disputes, unless a different forum is required by law.

12. Changes

We may update these Terms from time to time. We will post the revised Terms with an updated effective date. Continued use after changes become effective constitutes acceptance, except where applicable law requires additional consent.

13. Contact

Questions about these Terms: TrueCare 5280, admin@truecare5280.com.

These Terms are a practical template for a transportation service. They are not a substitute for legal advice; have them reviewed by qualified counsel for your organization and jurisdiction.
